Legal basis for processing

Art. 6 I lit. a GDPR serves our company as the legal basis for processing operations in which we obtain your consent for a specific processing purpose. This concerns the delivery of goods, the provision of other services or consideration as well as the implementation of pre-contractual measures (inquiries about our products and/or services).
If our company is subject to a legal obligation that requires the processing of your personal data, such as to fulfill tax obligations, the processing is based on Art. 6 I lit. c GDPR. In rare cases, the processing of your personal data may be necessary to protect your vital interests as a data subject or another natural person. This is the case if you were injured as a visitor to our company and your name, age, health insurance details or other vital information would then have to be passed on to a doctor, hospital or other third party. Then the processing would be based on Art. 6 I lit. d GDPR. Finally, processing operations can be based on Art. 6 I lit. f GDPR. Processing operations that are not covered by any of the aforementioned legal bases are based on this legal basis if the processing is necessary to protect a legitimate interest of our company or a third party, provided that your interests, fundamental rights and freedoms do not outweigh them. Such processing operations are permitted to GmbH because they have been specifically mentioned by the European legislator. It is considered that a legitimate interest can be assumed if you, as the data subject, are a customer of the controller, ie. GmbH (Recital 47 Sentence 2 GDPR).

Duration for which the personal data is stored

The criterion for the duration of storage of your personal data is the respective statutory retention period. After the deadline has expired, the data is routinely deleted unless it is no longer required to fulfill the contract or initiate a contract.

Legal or contractual regulations regarding the provision of personal data

We would like to point out that the provision of personal data is partly required by law (e.g. tax regulations) or also results from contractual regulations (e.g. information on the contractual partner). In order to conclude a contract, it may be necessary for a data subject to provide us with personal data, which will subsequently be processed by us. Failure to provide personal data will result in the contract not being concluded. Before providing personal data, the person concerned must contact GmbH. We clarify on a case-by-case basis whether the provision of personal data is required by law or contract or is necessary for the conclusion of the contract, whether there is an obligation to provide the personal data and the consequences of not providing the personal data.

Routine deletion and blocking of personal data GmbH processes and stores personal data of data subjects only for the period necessary to achieve the storage purpose or if this is required by the European legislator or another legislator in laws or regulations that .projects GmbH is subject to. If the storage purpose no longer applies or if a storage period prescribed by the European legislator or another responsible legislator expires, the personal data will be blocked or deleted routinely and in accordance with legal regulations.
